About this notice

Smartbeans is responsible for your Opportunity Check data.

Smartbeans Group, the operator of smartbeans.ltd, decides why and how personal information submitted through the Opportunity Check is used. This notice applies to Opportunity Check submissions and related service follow-up. It does not replace any privacy terms that may apply if you later enter into a separate client relationship with us.

Keep the description non-sensitive

Do not include customer-identifiable, confidential or sensitive information in your problem description. Use a broad operational summary without names, customer records, credentials, private employee information or protected business data.

02 / How we use it

To deliver your result and respond meaningfully

We use Opportunity Check information to:

  • generate, display and send your directional Opportunity Check output;
  • identify an opportunity fit tier, service starting path and areas for human discovery based on the answers you provide;
  • support a Smartbeans team member's review and follow up about services that appear relevant to your organisation; and
  • respond to questions or requests you send us about the Opportunity Check.
Lawful basis: your consent

Before submitting the Opportunity Check, we ask you to consent to this use of your information. You can withdraw that consent at any time by emailing us. Withdrawal does not affect processing already carried out before we receive your request.

03 / Service providers and sharing

Email delivery through FormSubmit

Opportunity Check submissions are sent to Smartbeans using FormSubmit. FormSubmit acts as a form-submission and email-delivery service: the information you submit passes through its systems so the completed record can reach our email inbox.

FormSubmit's published information does not identify a specific hosting location. Its processing may therefore take place outside Mauritius. We limit the Opportunity Check to business contact details and non-sensitive operational context, rely on your explicit submission consent for this workflow, and review this provider arrangement as part of our data-protection responsibilities. We do not sell your personal information. We do not share Opportunity Check information with third parties for their own advertising purposes. We may disclose information if required by law or when reasonably necessary to protect our rights or the rights of others.

04 / How long we keep it

A defined retention window

FormSubmit

Up to 30 days

FormSubmit may retain an archive of the submission for up to 30 days as part of its email-delivery service.

Smartbeans

Up to 12 months

Smartbeans keeps an inactive enquiry for up to 12 months from submission. For an active opportunity, the period runs from the last substantive contact. A converted client record follows the retention terms for that client relationship. We may keep relevant records longer where a legal, regulatory, dispute-resolution or record-keeping need requires it.

When information is no longer required, we delete it or remove identifying details where reasonably practicable.

05 / Security and access

Limited access and proportionate safeguards

Opportunity Check submissions are transmitted over encrypted web connections. Access to the Smartbeans mailbox and exported submission records is restricted to people who need the information to review and respond to the enquiry. We do not ask for passwords, customer records, payroll files, credentials, or uploaded confidential documents in the Opportunity Check.

06 / Opportunity Check output

Directional guidance for human review

The Opportunity Check automatically uses your structured answers to generate an opportunity fit tier, service starting path, possible systems potential, suggested baseline measures and discovery questions. This output is directional. It is not a diagnosis, ROI forecast, guarantee, or decision with legal or similarly significant effects.

The output is provided for human review. A Smartbeans team member can consider your problem description and wider operating context, discuss the generated output with you, and suggest a different starting path where appropriate.

07 / Your choices and rights

You can ask us to act on your information

You may ask to access the personal information we hold about you, correct inaccurate information, delete it, restrict how it is used, or object to particular processing. You may also withdraw your Opportunity Check consent or ask us to stop follow-up. Some requests may be limited where we must keep information to meet a legal obligation or establish, exercise or defend a legal claim.

You may also raise a concern with the Mauritius Data Protection Office.
